Article 1: Ownership provision
The rented bicycle is managed by the Tour of Flanders Center, referred as the 'lessor' of CRVV, which has thereby acquired all rights and obligations as if it was the owner. The renter is at all times responsible for the rented equipment and will take care of the rented bicycle and accessories.
Article 2: Prices
The renter declares to be aware of the rates for renting the bicycle and the accessories for one or more days. The rent must be paid in advance and must be considered as acquired.
In case of an early return, the full rental price remains valid as specified in the rental agreement. Regardless the fact that the renter does not collect the bicycle in accordance with the rental agreement, the renter is obliged to pay the rent.
Article 3: Conditions and terms of use of the bike
The lessor is supposed to have delivered the bike in good condition. The renter is deemed to have received the rented bicycle in good condition.
Upon receipt, the renter has to inspect the bike on damages and test if there is any defect. The renter must immediately return the bicycle in case of any damage or defect and state these damages/defects to the lessor.
When returning the bicycle(s), the lessor pays the warranty back to the renter after a technical inspection and if there are no damages found in the case a warranty as been asked. For damage or defects that are not due to normal wear and tear, the warranty for the amount of the damage will be withheld. Remaining amount will be reimbursed after repair. The renter must immediately pay the additional amount if the amount of the damage is bigger than the warranty. In case of theft or serious damage to the rented bicycle due to the negligence of the renter as determined by the local police, the renter must immediately pay the damage to the lessor. The purchase invoice of the bicycle serves as the reference.
The renter is obliged to immediately report any damages, accident or theft to the responsible of the rental center. In the case of theft, the renter must immediately report this to the local police.
In the event of loss or irreparable damage of the supplied accessories, compensation will be deducted based on the replacement value of the relevant accessories.
It is strictly forbidden to go on unpaved roads with the rental bike.
Persons under the age of 18 who are not accompanied by a parent, guardian or adult companion may not rent a bicycle.
Article 4: Warranty
During the pickup of the bicycle and accessories, the renter pays the lessor the warranty of 250 euros.
Article 5: Pickup and return
A copy of the identity card of the renter is taken when collecting the bike at the rental center.
If the rental bike is returned too late, the lessor will charge the price as stated on the CRVV website.
The rental bike must be returned to the rental center before the usual closing time (6 pm).
Article 6: Insurance and liability
When renting a bicycle, the renter can take an insurance for physical accidents and breakdown assistance. Hereby, the renter concludes a membership with Cycling Vlaanderen and is insured for that year through that membership. The renter declares to have received an information sheet with the specific modalities of this membership.
If the renter does not wish to take an insurance with the rental of the bicycle, he could just sign this document without taking the additional insurance. The renter will in no way be able to hold the lessor liable for any accidents, even if they may be a direct consequence of the use of the bicycle.
The renter cannot, under any circumstances, recover personal damage or damage to third parties (before, during and after the bicycle tours) from the lessor.
The CRVV and/or its companions are not responsible for any accidents that may occur during or outside the bike rides of both the guided and unaccompanied bike tours.
Article 7: Invalidity
If any condition of this agreement would prove to be invalid or void in whole or in part on the basis of prevailing law, then the condition will be deemed not to form part of the agreement and the remainder of the agreement will remain in full force and effect.
Article 8: Current law
The customer acknowledges that in the event of any disputes only the courts of the Ghent district will have jurisdiction.
